3855 Kodeksu cywilnego); w zakresie przewidzianym przepisami korzysta z ochrony przysługującej konsumentom.
- Usługa — odpłatne świadczenie doradztwa prawnego realizowane przez Usługodawcę.
- Umowa — umowa o świadczenie usług zawierana między Klientem a Usługodawcą.
§ 3. Rodzaj i zakres usług
Usługodawca świadczy odpłatne usługi doradztwa prawnego, w szczególności:
- porady i konsultacje prawne udzielane online (e-mail, telefon, wideokonferencja, komunikatory) oraz stacjonarnie w miejscu uzgodnionym z Klientem,
- sporządzanie pism, opinii prawnych i projektów dokumentów,
§ 6. Wynagrodzenie i płatności
Wysokość wynagrodzenia ustalana jest indywidualnie przed rozpoczęciem świadczenia usługi. Płatność następuje przelewem bankowym na rachunek wskazany w potwierdzeniu zlecenia albo gotówką — w przypadku konsultacji stacjonarnych.
Na żądanie Klienta Usługodawca wystawia rachunek zgodnie z obowiązującymi przepisami. Usługodawca nie jest czynnym podatnikiem VAT.
§ 7. Termin i sposób realizacji
§ 12. Pozasądowe rozwiązywanie sporów
Konsument ma możliwość skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń, w szczególności poprzez:
- zwrócenie się do powiatowego (miejskiego) rzecznika konsumentów,
- wystąpienie do wojewódzkiego inspektora Inspekcji Handlowej z wnioskiem o wszczęcie postępowania w sprawie pozasądowego rozwiązania sporu konsumenckiego.
Szczegółowe informacje dostępne są na stronie Urzędu Ochrony Konkurencji i Konsumentów: uokik.gov.pl. Skorzystanie z tych metod jest dobrowolne.
§ 13. Ochrona danych osobowych
Zasady przetwarzania danych osobowych opisane są w Polityce prywatności.
Usługodawca zastrzega prawo do zmiany regulaminu z ważnych przyczyn.

Terms of Service
Last updated: 1 July 2026
§ 1. General provisions
These Terms of Service set out the rules for the provision of legal advisory services, including by electronic means, and the rules for using the website trebacz-porady.pl.
The services are provided by Bartosz Trębacz, conducting unregistered business activity within the meaning of Article 5 of the Act of 6 March 2018 — Entrepreneurs' Law, operating under the name "Bartosz Trębacz Porady Prawne", based in Siechnice (55-011), Poland, e-mail: kontakt@trebacz-porady.pl, tel. +48 516 458 729 (the "Service Provider").
These Terms are made available free of charge in a manner that allows them to be obtained, reproduced and stored via the website. Commencing use of the services constitutes acceptance of these Terms.
§ 2. Definitions
- Client — a natural person, legal person or organisational unit using the Service Provider's services.
- Consumer — a natural person entering into a contract not directly related to their business or professional activity (Article 221 of the Polish Civil Code).
- Entrepreneur with consumer rights — a natural person entering into a contract directly related to their business activity where the contract is not of a professional nature for that person (Article 3855 of the Civil Code); to the extent provided by law, such person enjoys the protection afforded to consumers.
- Service — the paid provision of legal advice by the Service Provider.
- Contract — the service agreement concluded between the Client and the Service Provider.
§ 3. Type and scope of services
The Service Provider provides paid legal advisory services, in particular:
- legal advice and consultations provided online (e-mail, telephone, video conference, messaging apps) and in person at a location agreed with the Client,
- drafting of letters, legal opinions and draft documents,
- representation in administrative proceedings (Article 33 of the Code of Administrative Procedure).
The services cover in particular civil, family, real estate, labour, inheritance and administrative law.
Scope of authority. The Service Provider is not an advocate (adwokat) or attorney-at-law (radca prawny) within the meaning of separate statutes. The Service Provider does not provide court representation before common or administrative courts; he may act as a representative only to the extent permitted by applicable law, including in administrative proceedings.
§ 4. Technical requirements
To use services provided by electronic means, the following are required: a device with internet access, an up-to-date web browser and an active e-mail address.
The Client is prohibited from supplying unlawful content. The Client is obliged to use the website and the services in a manner consistent with the law and good practice.
§ 5. Conclusion of the contract
Information published on the website does not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract.
The contract is concluded when the Service Provider confirms acceptance of the assignment — by e-mail or telephone. Before the contract is concluded, the Service Provider informs the Client of the main features of the service, the completion date, the amount of remuneration and the right of withdrawal or its exclusion.
§ 6. Remuneration and payments
The amount of remuneration is agreed individually before the service begins. Payment is made by bank transfer to the account indicated in the confirmation of the assignment or in cash — in the case of in-person consultations.
At the Client's request, the Service Provider issues an invoice in accordance with applicable regulations. The Service Provider is not an active VAT payer.
§ 7. Time and manner of performance
The time for performing the service is agreed individually and stated in the confirmation of the assignment. The Service Provider begins performance after confirming acceptance of the assignment and — if so agreed — after payment has been made.
The Client is obliged to provide all information and documents necessary for the proper performance of the service.
§ 8. Right of withdrawal
A Consumer and an Entrepreneur with consumer rights may withdraw from a contract concluded at a distance or off-premises within 14 days of its conclusion, without giving any reason, by submitting a declaration to: kontakt@trebacz-porady.pl. Sending the declaration before the deadline is sufficient to meet it. The declaration may be made using the template set out in Annex 2 to the Act of 30 May 2014 on Consumer Rights, although this is not mandatory.
If the Client requested that performance of the service begin before the withdrawal period expires and then withdraws from the contract, the Client is obliged to pay for the services rendered up to the moment of withdrawal, in proportion to the scope of the service performed.
Exclusion of the right of withdrawal. The right of withdrawal does not apply where the Service Provider has fully performed the service with the Client's express and prior consent, the Client having been informed, before performance began, that they would lose the right of withdrawal once the service is fully performed (Article 38(1) of the Consumer Rights Act).
§ 9. Confidentiality
The Service Provider keeps confidential all information obtained from the Client in connection with the provision of services and uses it solely to perform the contract, except where a disclosure obligation arises from mandatory provisions of law.
The Client acknowledges that the Service Provider — not being an advocate or attorney-at-law — is not covered by the statutory advocate's or attorney's professional privilege. Confidentiality is ensured on the terms set out in these Terms and in data protection law.
§ 10. Liability
The Service Provider provides the services with the due diligence required of an advisory business. The Service Provider's obligation is one of due care, not of a specific result — advice and opinions do not guarantee any particular outcome of a case or proceedings.
Opinions and advice are issued on the basis of the legal situation and the information provided by the Client as at the date they are prepared. The Service Provider is not liable for the consequences of incomplete or untrue information provided by the Client, or for use of the advice inconsistent with its intended purpose.
The provisions of this section do not exclude or limit the Service Provider's liability towards a Consumer or an Entrepreneur with consumer rights to the extent that this is prohibited by mandatory provisions of law.
§ 11. Complaints
Complaints should be submitted to: kontakt@trebacz-porady.pl. A complaint should include the Client's details, a description of the objections and the expected manner of resolution.
The Service Provider examines the complaint and responds within 14 days of receipt. Failure to respond within this period to a Consumer's complaint means that the complaint is deemed accepted.
§ 12. Out-of-court dispute resolution
A Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular by:
- contacting the district (municipal) consumer ombudsman,
- applying to the provincial inspector of the Trade Inspection to initiate proceedings for the out-of-court resolution of a consumer dispute.
Detailed information is available on the website of the Office of Competition and Consumer Protection: uokik.gov.pl. Use of these methods is voluntary.
§ 13. Personal data protection
The rules for processing personal data are described in the Privacy Policy.
§ 14. Final provisions
Matters not governed by these Terms are subject to Polish law, in particular the Civil Code, the Act on Providing Services by Electronic Means, and the Consumer Rights Act.
Any disputes are settled by the court having jurisdiction under the Code of Civil Procedure. This provision does not limit the Consumer's rights under mandatory provisions on the jurisdiction of courts.
The Service Provider reserves the right to amend these Terms for valid reasons. Contracts concluded before the amendment are governed by the Terms in force on the date the contract was concluded. The current version is available at trebacz-porady.pl/regulamin.html.

§ 5. Vertragsschluss
